AGREEMENT TO OUR LEGAL TERMS

We are EcoVizi ("Company", "we", "us", or "our").

We operate the website https://www.ecovizi.com and related products and services (collectively, the "Services").

These Legal Terms constitute a legally binding agreement between you and EcoVizi concerning your access to and use of the Services.

If you do not agree with these Terms, you must discontinue use of the Services immediately.

1. OUR SERVICES

EcoVizi provides solar monitoring, energy analytics, sustainability intelligence, carbon impact estimation, renewable energy insights, performance monitoring, reporting tools, and related services.

The Services are intended for lawful use only.

Users accessing the Services from jurisdictions outside India do so at their own risk and are responsible for compliance with local laws.

2. INTELLECTUAL PROPERTY RIGHTS

All content, software, dashboards, reports, analytics, designs, logos, trademarks, source code, databases, and intellectual property displayed through EcoVizi remain the exclusive property of EcoVizi or its licensors.

You may not:

  • Reproduce
  • Redistribute
  • Reverse engineer
  • Sell
  • License
  • Commercially exploit

any part of the Services without prior written permission.

3. USER REPRESENTATIONS

By using the Services, you represent that:

  • You are at least 18 years old.
  • Information provided by you is accurate.
  • You will not violate any applicable law.
  • You will not misuse the Services.
  • You have authority to provide any information uploaded to the platform.

4. PROHIBITED ACTIVITIES

You agree not to:

  • Upload malware, viruses, or harmful code.
  • Scrape or harvest platform data.
  • Interfere with service functionality.
  • Impersonate another person.

Violation may result in suspension or termination of access.

5. USER GENERATED CONTRIBUTIONS

Users remain responsible for content submitted through the Services.

EcoVizi reserves the right to remove any content that violates these Terms.

6. CONTRIBUTION LICENSE

8. TERM AND TERMINATION

These Terms remain effective while you use the Services.

We may suspend or terminate access without prior notice if:

  • Fraudulent activity is detected.
  • Legal obligations require termination.
  • Security risks arise.

9. MODIFICATIONS AND INTERRUPTIONS

EcoVizi may:

  • Add or remove functionality.
  • Temporarily suspend services.
  • Conduct maintenance.

We do not guarantee uninterrupted availability.

10. GOVERNING LAW

These Terms shall be governed by and interpreted according to the laws of India.

The courts of Jaipur, Rajasthan, India shall have exclusive jurisdiction over disputes not resolved through arbitration.

11. DISPUTE RESOLUTION

Informal Negotiations

Before initiating formal proceedings, both parties agree to attempt informal resolution for 30 days.

Binding Arbitration

If the dispute cannot be resolved informally:

  • Governing Law: India
  • Arbitration Language: English
  • Number of Arbitrators: 1

The arbitration decision shall be final and binding.

Exceptions

The following may proceed directly through courts:

  • Intellectual Property claims
  • Injunctive relief requests
  • Fraud or unauthorized access claims

12. CORRECTIONS

Information on the Services may occasionally contain errors or omissions.

EcoVizi reserves the right to correct inaccuracies without prior notice.

13. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

EcoVizi DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT

We do not guarantee:

  • Continuous availability
  • Accuracy of third-party data
  • Error-free operation
  • Uninterrupted access

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ECOVIZI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED:

THE AMOUNT PAID BY THE USER TO ECOVIZI DURING THE PRECEDING SIX (6) MONTHS.

15. INDEMNIFICATION

You agree to defend and indemnify EcoVizi from claims arising from:

  • Violation of these Terms
  • Misuse of Services
  • Violation of law
  • Violation of third-party rights

16. USER DATA

EcoVizi stores and processes data in accordance with its Privacy Policy.

Users remain responsible for maintaining backup copies of information they submit.

17. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive communications electronically, including:

  • Emails
  • Notices
  • Account Updates
  • Policy Updates

Electronic communications satisfy legal requirements for written communication.

18. MISCELLANEOUS

These Terms constitute the entire agreement between you and EcoVizi.

If any provision becomes unenforceable, remaining provisions shall remain valid.

Failure to enforce any provision does not constitute waiver.
